Члан 173а
Ко у намери да оствари право на неоснован повраћај пореза или порески кредит, поднесе пореску пријаву неистинитог садржаја, у којој искаже износ за повраћај пореза или порески кредит од 500.000 до 3.000.000 динара казниће се затвором од три месеца до три године и новчаном казном.

  -> Thanks; yes, in both languages the term automatically implies fraudulency.

neutral  Natasa Stankovic: Donekle se slažem, ali samo u prvom koraku (što je i ovde slučaj): neosnovano = unfounded, a tek u sledećem koraku može se razmatrati tj. utvrđivati da li to ’implies fraudulency’. To svakako nije ’automatically’ i o tome odlučuju sudovi - i u SR i u UK.

  -> Ovde nema reči o pretpostavkama već koje su pravne konsekvence kod već utvrđenog krivičnog dela. Neosnovano iskazivanje je pravni termin koji podrazumeva učinjenu prevaru, i prevodu ‘unfounded’ tu zapravo nema mesta.
