Japanese term or phrase: 生存特許
I am working on an academic paper on innovation. Part of the paper deals with patents, a subject I am not familiar with. In this particular section, the discussion centers on 生存特許 vs. 権利が消滅した特許 (patents for which patent rights have expired?). I assume that 生存特許 means roughly an active, or valid, patent, but am not sure, and also don't know how to best refer to this in English.

Any help is sincerely appreciated.

alive patent
Explanation:
I find that patent attorneys talk about a patent or a patent application that is alive or dead. The meaning may be slightly different for a patent from that for a patent application.
