Risk-Born-by-Debtor Principle Explanation: According to アメリカ契約法[第2版], it seems that in the United States there is no legal principle or term concerning risk of loss equivalent to 債務者主義. Reference: Article 536-I Reference information: It s a doctrine to govern a situation, e.g., where an employee becomes unable to work without the fault of both his/her employer and him/herself. The employee does not get paid under 536-I, hence he/her assumes risks. |
