beslissende eed opdragen Explanation: Ho condotto diverse ricerche e la soluzione meno improbabile mi sembra questa. Nel diritto belga dicono gedingbeslissende eed opdragen, però in Olanda, come sai, è sempre un po' diverso. Ci sono arrivata per vie traverse, passando anche per l'inglese. Ecco qualche riferimento: http://www.dirittoprivatoinrete.it/giuramento.htm In merito al giuramento decisorio notiamo che la parte che deve giurare può, appunto, giurare, e vincere la causa, non giurare o non presentarsi senza giustificato motivo, e perdere la causa, oppure riferire il giuramento a chi glielo ha deferito; in altre parole la parte invece di giurare chiede all’altra di giurare in sua vece. Se la parte cui è stato riferito il giuramento si rifiuta di giurare perderà lei al causa, diversamente se giura vincerà, ma non potrà a sua volte riferire il giramento alla parte che glielo aveva riferito.
