In a pledge contract I find the following :

"Le Constituant accepte de remettre en gage et grève de gage en faveur du......... " concerning a stock of product set aside as collateral etc. 'Gage' I understand but I have difficulty in finding a suitable term for 'grève de gage'.

Note: the text is in Swiss French and concerns Swiss law.

Can any of you legal eagles help please?

FR : "3 Si des parts de copropriété sont grevées de droits de gage ou de charges foncières, les copropriétaires ne peuvent plus grever la chose elle-même de tels droits."

EN: "3 Where mortgage rights or real burdens apply to co-ownership shares, the co-owners are not permitted to further encumber the object itself with such charges."

Par exemple, grève de l'impôt = refus de payer l'impôt

Donc, dans ce cas, grève de gage = refus de gager.
