LE CONTRAT DE MISSION : DÉFINITION

Le contrat de mission est un contrat spécifique au travail temporaire. Il s’agit donc d’un contrat entre une travailleur temporaire et une agence de travail temporaire, dans le but de réaliser une tâche, une mission, bien précise. Les experts ajoutent que d’un point de vue juridique, le contrat de mission s’apparente beaucoup au Contrat à Durée Déterminée (CDD).

Il est signé entre le salarié et l’entreprise de travail temporaire. Il sera adressé à l’intérimaire au plus tard dans un délai de 2 jours. L’intérimaire sera mis à la disposition du client de l’entreprise. Le contrat de mission doit être signé, autrement il sera requalifié en CDI. Par ailleurs, le salarié peut toucher dans ce cas-là des indemnités, payées par l’entreprise, équivalentes à un mois de salaire maximum.

La durée
Le contrat de mission d’intérim ne doit pas être conclu pour une durée supérieure à un an et demi. Néanmoins, cette période peut être étendue à deux ans quelques fois.

La période d’essai
Il existe une période d’essai dans ce type de contrat. Elle varie selon le contrat. Et si aucune convention d’entreprise ou de branche n’a été signée, la période d’essai ne peut pas aller au-delà de cinq jours.
