BIS Issues Proposed Rule to Add Software Used to Operate Nucleic Acid Assemblers and Synthesizers to Commerce Control List
On November 6, 2020, BIS issued a proposed rule to amend the Commerce Control List (CCL) by adding a new Export Control Classification Number (ECCN), 2D352, to control “software” related to nucleic acid assemblers and synthesizers controlled under ECCN 2B352.j.
Such software has been identified as an emerging technology pursuant to the Export Control Reform Act based on a finding that the software is capable of being used in the production of pathogens and toxins.
The purpose of the rule is to prevent exploitation of this software to create biological weapons material.
BIS issued this proposed rule pursuant to its authority under Section 1758(a) of ECRA which authorizes BIS to set appropriate controls on the export, reexport, or transfer of emerging and foundational technologies.
