Jedynym rozróżnieniem będzie podawanie terminu w oryginale po angielsku. Wygląda, że co stan to inaczej. W Polsce chyba w każdym przypadku będzie to kradzież.

Sprawa jest mocno skomplikowana i sięga do samego dna :)

In general, theft is one of the more common crimes committed in the United States. It involves taking a person’s property without the owner’s permission to deprive them of that property. A common example, and crime committed, under theft is shoplifting.

To qualify as a “theft” crime, three elements must be present.

A General Overview of Larceny

Most states will say that larceny is defined by that fact that you took property that is owned by someone else, you did not have permission, and you did so with intent to deprive the owner of that property. Therefore, it is a lot like theft. The only difference, however, is that larceny crimes are often felonies, while theft crimes are charged as misdemeanors.

Kiedy kradzież jest przestępstwem a kiedy wykroczeniem? O wykroczeniu można mówić w przypadku, jeśli wartość szkody wynosi mniej niż 500 zł, natomiast o przestępstwie, gdy granica ta jest na poziomie 500 zł. Do listopada 2018 r. wartość szkody wynosiła jedną czwartą minimalnego wynagrodzenia za pracę, jednak nowelizacja ustawy wprowadziła kwotę na poziomie 500 zł. Warto mieć jednak na uwadze, iż to ograniczenie nie obowiązuje w przypadku kradzieży broni, amunicji oraz materiałów bądź przyrządów wybuchowych. W takich sytuacjach zawsze jest to przestępstwo i obowiązuje wtedy kodeks karny.

Kiedy można mówić o kradzieży? Przestępstwo to może zostać popełnione jedynie w sposób umyślny, w zamiarze bezpośrednim. Należy jednak pamiętać, iż niezbędne jest, by sprawca działał po to, by przywłaszczyć rzecz (przejąć nad nią trwałą władzę). Nie jest istotne czy zamierza ją włączyć do swojego majątku. O kradzieży mówi się również, gdy sprawca ma zamiar skradzioną rzecz np. przekazać komuś innemu.

Theft crimes are crimes that involve the unauthorized taking of the property of another with the intent to deprive them of it permanently. Historically, theft involved three different categories of crime: larceny, embezzlement and false pretenses. Embezzlement was defined as the fraudulent taking of the property of another by someone who is in lawful possession of it. For example, if a banker takes the money of one of his customers this may be embezzlement. False pretenses involved a false representation of a fact by a defendant that caused another to hand over title to property to the defendant. In most states, these two crimes are now incorporated within the broader crime of larceny and the term “theft crime” is used to represent different types of property crimes, including larceny, robbery, burglary, shoplifting and auto theft.
