Στα ελληνικά λέμε «στην παρουσία του διαθέτη» (και, στην καθαρεύουσα, «παρόντος του διαθέτη» ή «εν τη παρουσία του διαθέτου»).

Δεν βρήκα αξιόλογα ευρήματα με «ακοή» ή «ακρόαση». Ίσως θα θέλαμε να προσθέσουμε το «αυτήκοη» στην «παρουσία» για να ικανοποιήσουμε το αγγλικό, αλλά κι αυτό δεν συνηθίζεται.
