on a non reliance basis implique qu’aucun raisonnement ne peut s’appuyer sur l’avis rendu, lequel peut cependant être évoqué, mentionné, cité, etc. tant qu'on ne lui accorde pas (other than) la force d'une preuve/d'un argument (not to be relied upon).

Je ne sais pas ce qu’en pensent les anglophones natifs, mais may not be relied upon upon other than on a non-reliance basis ne me semble pas très heureux et je ne me sens pas obligé de suivre le texte source à la lettre (sans parler de la voix passive, etc.). Et donc, sauf à se lancer dans une périphrase, « uniquement à titre indicatif/d’information » me semble couvrir le sens.

D’où :

« Aucun tiers ne peut divulguer le présent Avis ou s’appuyer sur celui-ci sans notre consentement écrit à moins que ce ne soit uniquement à titre indicatif/aux fins d’information, étant expressément entendu que… »

« non-reliance basis » veut dire, selon moi, « qui ne repose pas sur », « qui ne s’appuie pas sur », « qui ne respecte pas » le « strict understanding that we assume no responsibility ». Ou encore, « qui va à l’encontre » du principe [ou le fait] que nous n'assumons aucune responsabilité.

Un peu de verbiage ici dans cette phrase anglaise alambiquée, mais je la comprends et la traduirais comme suit :

« La présente opinion ne peut être divulguée ni invoquée sans notre consentement écrit et par quiconque allant à l’encontre du principe [ou du fait] que nous n'assumons aucune responsabilité lorsque cette divulgation s’adresse à des administrateurs. »
ou
« La présente opinion ne peut être divulguée ni invoquée sans notre consentement écrit et par quiconque ne respecte pas le principe [ou le fait] que nous n'assumons aucune responsabilité lorsque cette divulgation s’adresse à des administrateurs. »

agree  Eliza Hall: Yes, that's what this means. It can't be disclosed unless it is treated as purely informational and not something one can rely on in making any kind of decision, legal decision, etc.
