English term or phrase: not in play
6 In about June 2012, Mr Cash suggested to the Claimant that he pay money into an account to be available for projects being undertaken by, amongst others, Mr Cash and Mr Jimenez, which wouid pay 6% whilst not in play, and more once used for a particular project. The Clamant transferred £650,000 in June 2012 on this basis. That is, it was transferred without security and for no specific purpose initially, on the basis that it would later be agreed with Mr Cash and Mr Jimenez towards what it would be applied. It was always understood that this would involve a yield on the money invested, but no participation in any underlying development project.

Explanation:
As far as I understand, Mr Cash and Mr Jimenez would pay 6% when the account is not in use (in play), and more when used in a project.
